Comprehensive Privacy Notice of the Universidad Autónoma del Estado de Hidalgo

The Autonomous University of the State of Hidalgo (UAEH) with address located at Calle Mariano Abasolo, Number 600, Colonia Centro, Pachuca de Soto, State of Hidalgo, Mexico, C.P. 42000, recognizes the fundamental right to the protection of personal data, with the purpose of guaranteeing privacy and the prerogative of informative self-determination of individuals. 42000, recognizes the fundamental right to the protection of personal data, with the purpose of guaranteeing the privacy and the prerogative to the informative self-determination of the persons, consequently it is responsible for the obtaining, use, registration, organization, conservation, elaboration, use, communication, diffusion, storage, possession, access, handling, use, disclosure, transfer, protection or disposition (treatment) of the personal data provided by the owner of the same and/or legal representative and/or who exercises the parental authority, which will be protected in accordance with the provisions of the General Law for the Protection of Personal Data in Possession of Obligated Subjects, General Law of Transparency and Access to Public Information, Law for the Protection of Personal Data in Possession of Obligated Subjects for the State of Hidalgo, and Law of Transparency and Access to Public Information for the State of Hidalgo, always acting within an unrestricted framework of respect for human rights and the principle of the best interest of the child and other applicable regulations.

II. Purposes of the processing of personal data and sensitive personal data processed by the UAEH

The purpose of the treatment of data by the UAEH is based on Article 3 of its Organic Law.

Article 3. The purposes of the University are

  • Teaching: To organize, provide and promote classroom and distance education at the high school, professional-technical, undergraduate and graduate levels, to train high quality human capital, according to the needs of the global society, and especially of Mexico and the State of Hidalgo, allowing the timely incorporation of its graduates to productive work;

  • Research: To organize, carry out, promote and guide scientific, humanistic and technological research in its basic and applied forms, in order to link human knowledge to the productive sphere and respond to the needs of the integral development of society;

  • The creation, preservation and dissemination of culture: To organize, carry out and promote cultural and artistic creation and dissemination in its various forms of expression, in order to extend its benefits to all sectors of the population, fostering national and state identity, social solidarity and the preservation of the multicultural, ethnic and natural heritage of the state of Hidalgo and society in general;

  • Linkage: To relate harmoniously and efficiently with other institutions and entities of society, ensuring that its activities generate greater social and cultural welfare and an increase in national productivity;

  • The promotion of legality, transparency and protection of human rights: To carry out its activities in accordance with the fundamental laws of the nation, building and improving its internal regulatory order, to promote a culture of legality and accountability with transparency. Likewise, to promote the study and protection of the fundamental rights and duties of man, especially in the university environment, fostering the harmonious coexistence of the university community.

  • The promotion of quality and excellence: To carry out all its planning, operation and management, academic and administrative activities with the highest quality, susceptible to be evaluated and compared with global excellence indicators, seeking an optimal development of the institution that will allow it to establish and maintain its position among the best university institutions in the world.

In order to comply with the privacy notice and other applicable legislation on the subject, we inform you that the aforementioned data are obtained through the following ways:

  • Personally: When you go directly to the UAEH to request or contract our procedures and services.
  • Direct: When you provide us with your personal data to request or contract procedures and services through our website, by telephone, e-mail or any other technological means.
  • Indirect: From any other source of information permitted by law.

The UAEH informs you that the personal data provided and containing sensitive information in terms of the applicable regulations, are confidential and therefore are not distributed, disseminated or marketed, receiving special treatment for their safekeeping and protection.

III. Legal basis authorizing the treatment of the purposes

In compliance with the provisions of articles 1, 2, 3, 4, 5, 6, 7, 8 of the Organic Law, 1, 2, 3, 4, 5, 6, 7, 8 and 9 of the General Statute, both legal ordinances of the Autonomous University of the State of Hidalgo, which contain the principles, powers and obligations that the UAEH has for the fulfillment of its nature, purposes and organization for which the collection of personal data is necessary.

Likewise, in compliance with the provisions of Articles 3 section XXXV, 12, 13, 15, 15, 16, 35, 37, 39, 42 and 45 of the Law for the Protection of Personal Data in Possession of Obligated Subjects for the State of Hidalgo, as well as the provisions of paragraphs 3 section XXXIII, 17, 18, 19, 26, 27, 28 and 29 of the General Law for the Protection of Personal Data in Possession of Obligated Subjects.

IV. Purposes of the Transfers

The UAEH to fulfill the purposes detailed in point III of this legal instrument, as well as those referred to in accordance with the provisions of Articles 19, 97, 98 and 99 of the Law on Protection of Personal Data Held by Obligated Parties for the State of Hidalgo, and 22, 66 and 70 of the General Law on Protection of Personal Data Held by Obligated Parties or that required by competent authorities, will transfer only those personal data that are indispensable in the terms set forth below:

  • When a law so provides, such assumptions must be in accordance with the bases, principles and provisions set forth in the Law for the Protection of Personal Data in Possession of Obligated Parties for the State of Hidalgo as well as those set forth in the General Law for the Protection of Personal Data in Possession of Obligated Parties, and in no case may they contravene it.
  • When institutions, organizations and companies that are part of the university job bank and employment programs for graduates, with the aim of providing job opportunities and improvements.
  • When national and foreign educational institutions as well as non-educational organizations and companies, for the purpose of authenticating and legitimizing the documents that accredit the studies carried out.
  • When institutions, organizations and companies with which we have entered into general and specific collaboration agreements with the purpose of offering their products and services.

In order to restrict the transfer of your personal data for those cases in which your consent is necessary and you do not agree, you can make your request to the e-mail unidadtransparencia@uaeh.edu.mx. Such request must comply with the provisions of the following point.

V. Mechanisms, Means and Procedures for the Exercise of ARCO Rights (Access, Rectification, Cancellation and Opposition)

At any time you or your legal representative may request access, rectification, cancellation or opposition (ARCO rights) to the processing of personal data concerning you in accordance with the provisions of the law on the subject.

  1. Right of access: you have the right to access your personal data in our possession, as well as to know the information related to the conditions and generalities of its treatment.
  2. Right of rectification: you have the right to ask us to rectify or correct your personal information when it is inaccurate, incomplete or outdated.
  3. Right of cancellation: it is your right to request the cancellation of your personal data from our files, records, files and systems, so that they are no longer in our possession and we stop processing them.
  4. Right to object: finally, it is also your right to object to the processing of your personal data or to demand the cessation of such processing.

In order to exercise the aforementioned rights, you must comply with the following:

  1. Submit a request to the Transparency Unit of the UAEH through:

  2. 1.1 The application must contain the following requirements:

    1. Name of the holder and address or any other means to receive notifications.
    2. Documents proving the identity of the holder and, if applicable, the legal capacity and identity of its legal representative.
    3. If possible, the area responsible for processing the personal data and to which the request is submitted.
    4. A clear and precise description of the personal data with respect to which you are seeking to exercise any of the ARCO rights, except in the case of the right of access.
    5. The description of the ARCO right to be exercised, what the holder is requesting,
    6. Any other element or document that facilitates the location of personal data.

    1.2 Depending on the type of application you should consider:

    1. In the case of a request for access to personal data, you should indicate the form in which you prefer the data to be reproduced.
    2. In requests for rectification of personal data, you must specify the modifications to be made.
    3. In relation to a cancellation request, you must indicate the causes that motivate you to request the deletion of your personal data in the files, records or databases of the data controller.
    4. In the case of the opposition request, you must state the legitimate causes or the specific situation that lead you to request the cessation of the processing, as well as the damage or harm that the persistence of the processing would cause you, or if applicable, the specific purposes for which you need to exercise the right of opposition.

    1.3 Means to prove the identity of the holder and the identity and personality of the legal representative.

    1. Holder by means of a valid official identification (of those referred to in point II; identification data of this notice).
    2. Legal representative or legal proxy by means of a power of attorney or notarial instrument (of those referred to in item II; identification data of this notice).
    3. Person other than you or your legal representative, in those cases provided for by law or, if applicable, by court order.
    4. In the case of minors or persons who are in a state of interdiction or incapacity, in accordance with the laws on civil or family matters, the rules of representation set forth in the same legislation shall apply.
    5. With respect to personal data concerning deceased persons, the person who proves to have a legal interest, in accordance with the applicable laws, provided that the holder of the rights has expressed his will or that there is a court order.

  3. Clarification of the application.

    In the event that the request for data protection does not meet some of the above requirements and the ITAIH does not have the elements to correct it, it will be notified so that within a period of 5 working days following the submission of the request, on a single occasion, to correct the omissions within a period of 10 working days from the day following the day of notification. Once the term has elapsed without the prevention being addressed, the request for the exercise of ARCO rights will be deemed not to have been filed.

  4. Time to respond to the request.

    The response period shall not exceed 20 business days from the day following receipt of the request. This period may be extended by up to 10 working days when justified by the circumstances.
